The Senior Compliance Manager will be a key member of Hitachi Rail’s compliance function that is responsible for delivering a compliance programme for the Rail business unit, consistent with the rapidly evolving compliance landscape within the Hitachi Group.

This role, reporting into Hitachi Rail’s Chief Compliance Officer, will work closely with the wider Hitachi Rail Legal & Compliance team globally, as well as the Compliance teams of Hitachi Group and its affiliates. The role will require agility in navigating the organisation, and an ability to positively influence and secure stakeholder buy-in with clear and concise communication. Beyond collaboration within Legal & Compliance, regular interaction and partnership with colleagues in Engineering, Sales/Commercial, Finance, Internal Audit, Procurement, and Logistics functions should be anticipated.

From the outset, this role will be expected to support key elements of the compliance programme. The successful candidate, to be based in [Italy OR UK], will be an empowered member of the global Compliance team with technical remit to lead specifically on the export and trade compliance programme. The successful candidate may also be tasked on certain geographic or other responsibilities for operational deployment of the programme as a whole, including but not limited to procurement compliance and training and communications. This role will focus on leveraging particular skills and expertise in export and international trade compliance controls such as product classification (dual use), screening and sanctions due diligence, licensing, export and re-export-related processes, and documentation management.

Key Responsibilities:
Support the Chief Compliance Officer by leading and developing a “best-in-class” export and trade compliance programme, promoting ethical behavior and building a strong “compliance culture” from management downwards as it pertains to export and trade compliance.

Play a key role in cross-functional communication and influencing, building relationships and counselling stakeholders on export, trade control, and sanctions risks.

Develop and deliver advice, communications, templates and tools, setting and monitoring KPIs, and delivering on key processes related to export and trade compliance.

Ensure compliance across Hitachi Rail with Hitachi Group Corporate Export Regulation Department (CERD) requirements and notices, and maintain and build effective engagement with CERD.

Maintain the Hitachi Rail Export and Trade Compliance Programme Manual and verify the consistent application of related procedures by partner functions in Engineering, Commercial, Procurement, and Logistics.

Oversee and verify compliance of Hitachi Rail’s workforce with the Export Compliance Programme.

Deliver targeted training to all of Hitachi Rail’s workforce, with a particular focus on first-line of defense functions and departments to manage and mitigate risks.

Partner with relevant functions to ensure product classification in relevant tools and systems.

Conduct assessments and audits of the Export and Trade Compliance Programme in partnership with internal and external auditors and Hitachi Group stakeholders as required.

Maintain and ensure compliance with EU Regulation and US Export Administration Regulation (EAR) requirements.

Maintain and build relationships with relevant local authorities responsible for issuing export licenses, primarily BIS and MAE/UAMA (Italy), as well as other European authorities when required per business needs.

Maintain an export license registry.

Collect relevant documentation and prepare submission files for obtaining authorisations/licenses from relevant, competent authorities.

Verify the consistency of the documentation prepared during the export, re-export, and re-transfer of Dual Use Export Controlled goods with respect to the authorisations/licenses issued by competent authorities.

Proactive horizon scanning of the regulatory environment to ensure Hitachi Rail procedures are updated timeously if there are changes to applicable laws and regulations.

Escalate and report to the General Counsel and Chief Compliance Officer immediately on any potential violations of the regulations on the export, re-export, and transfer of products.

The Candidate

It is our expectation that applicants should possess the following qualifications and experience:

Degree in Law, Finance or other relevant professional qualification.

At least 5 years’ combined experience as a practising compliance professional in a top tier law firm or industrial company.

Has managed a significant part of an export and trade compliance programme for an international company, preferably with familiarity of the Italian regulatory landscape.

In addition, the successful candidate should be to demonstrate the attributes and skills listed below:

Familiarity with global compliance practices, particularly on export and trade compliance, as implemented in multi-national companies.

Experience with EU and UK Regulation, as well as US Export Administration Regulation (EAR). Familiarity with Authorized Economic Operator (AEO) certification.

Good verbal and written communications skills, listening, influencing and presentation skills, ability to work and communicate in a diverse global organisation.

Ability to prioritize and manage multiple tasks simultaneously, strong at problem-solving and critical thinking, business and financial acumen.

Team player, with cultural awareness and curiosity, willing to work with other functions and members of the global Legal & Compliance team on joint initiatives.

Absolute integrity and trustworthiness plus the credibility and ability to communicate the importance of the same to all levels of the organisation.

Any additional language skills, while not required, would be advantageous.
